Anti-discrimination laws prohibit employers from asking employees about their health or their real or perceived disabilities in most circumstances – but not all.
There are certain circumstances under which employers are authorized to make “disability-related inquiries” or otherwise require employees to undergo medical examinations, and these rights vary based upon the stage of the employment relationship.
This webinar will explore the employer’s rights to make disability-related inquiries and/or require medical examinations through an analysis of the employer’s rights at the pre-hire stage, after a conditional job offer is extended, but before the individual starts working, and after an individual becomes an employee.
